1. Who these terms are for

1.1 This website is operated by BYS Flora International B.V. in formation (in oprichting), whose details are in our Legal Notice. By using the site you accept these terms.

1.2 The site is aimed at businesses in the horticultural trade. It is not aimed at consumers, and we do not sell to them.

2. What is on the site

2.1 Catalogues, availability lists, lead times, indicative prices and photographs are provided for information. They are not an offer and do not bind us. A binding agreement arises only when we issue an order confirmation under our Buyer Terms.

2.2 Availability, sizes and prices in the plant trade change constantly. We update the site in good faith but do not promise it is current or complete at any moment.

2.3 Nothing on the site is advice about growing, plant health, import requirements or the law in your country. Requirements differ by destination and by species, and you are responsible for what applies to you.

3. Our content

3.1 The text, photographs, catalogue structure and the software behind the portal belong to us or our licensors.

3.2 You may look at the site, and print or save pages for your own business use. You may not copy the catalogue or photographs into your own listings, republish them, or extract data from the site in bulk, by automated means or otherwise, without our written permission.

3.3 Plant variety names and trade marks that appear on the site belong to their owners, and nothing here grants you a licence to use them.

4. The portal

4.1 Access to the portal requires an account we have approved. What you may do with it is set out in the Supplier Terms or Buyer Terms you accepted when registering.

4.2 Keep your credentials to yourself. Tell us promptly at info@bysflorainternational.com if you think someone else has used your account.

4.3 Do not attempt to access data that is not yours, to test or bypass the site's security, or to disrupt the service. If you find a weakness, tell us at info@bysflorainternational.com and give us a reasonable chance to fix it before telling anyone else.

5. Availability and liability

5.1 We try to keep the site available but do not promise it will be uninterrupted. We may change or withdraw any part of it.

5.2 To the extent the law allows, we are not liable for any loss arising from the use of this website, including decisions taken on the basis of indicative information. This does not limit our liability under a contract for the sale of plants, which the Buyer Terms govern, nor liability that cannot be excluded by law.

5.3 Where we link to other websites, we do not control them and are not responsible for them.

6. Law

6.1 These terms are governed by Dutch law. Disputes go to the competent court in Rotterdam.

6.2 We may change these terms. The version in force is the one published here when you use the site.
